Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the VeriField Pro MSHA platform (“Platform”) operated by VeriField Pro LLC (“VeriField Pro,” “we,” “us,” or “our”). This AUP supplements and is incorporated into our Terms of Service. All capitalized terms not defined herein have the meanings set forth in the Terms of Service.
1. Overview
The VeriField Pro MSHA platform is a safety compliance tool designed exclusively for managing mine safety operations under MSHA regulations. The Platform handles safety-critical data including inspection records, training documentation, incident reports, and emergency management information. Misuse of the Platform can have serious consequences for worker safety and may constitute violations of federal law.
This AUP establishes the rules and expectations for all users of the Platform. By accessing or using the Platform, you agree to comply with this AUP.
2. Permitted Uses
The Platform is intended solely for the following lawful purposes:
- Managing MSHA safety compliance for surface metal/nonmetal mining operations.
- Recording and managing mine site check-in and check-out procedures.
- Conducting, documenting, and tracking workplace examinations, pre-operational inspections, and vehicle inspections.
- Creating, managing, and maintaining miner training records as required by 30 CFR Part 46 and Part 48.
- Reporting and documenting hazards, incidents, near-misses, and accidents.
- Managing emergency action plans, muster operations, and lone worker monitoring.
- Generating compliance reports, audit trails, and regulatory documentation.
- Managing visitor and contractor access to mine sites.
- Accessing safety data sheets (SDS) for chemicals present at mine sites.
- Administrative functions including user management, site configuration, and organizational settings.
3. Prohibited Uses
You are strictly prohibited from using the Platform to:
3.1 Safety Record Falsification
- Create, submit, alter, or maintain false, fraudulent, misleading, or inaccurate safety records, inspection reports, training documentation, or compliance records.
- Backdate or fabricate inspection entries, training completions, or check-in records.
- Delete or conceal records to hide safety violations, incidents, or compliance deficiencies.
- Check in another person using your account or allow another person to check in using your credentials.
3.2 Safety Protocol Circumvention
- Bypass, circumvent, or undermine any safety protocol, procedure, or regulatory requirement.
- Disable or interfere with safety alerts, notifications, or emergency features.
- Use the Platform in a manner that could endanger the health or safety of mine workers.
3.3 Unauthorized Access
- Share your login credentials with any other person.
- Access or attempt to access another user's account, data, or records without authorization.
- Access data belonging to any organization other than your own.
- Use automated scripts, bots, or other tools to access the Platform without our prior written consent.
3.4 Harmful Activities
- Upload, transmit, or distribute viruses, malware, ransomware, or any malicious code.
- Attempt to probe, scan, or test the vulnerability of the Platform or breach security measures.
- Interfere with, disrupt, or create an undue burden on the Platform or its infrastructure.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform.
3.5 Other Prohibited Activities
- Use the Platform for any purpose unrelated to mine safety compliance.
- Resell, sublicense, or commercially exploit the Platform without authorization.
- Use the Platform to harass, threaten, defame, or discriminate against any person.
- Violate any applicable federal, state, or local law, rule, or regulation.
4. Falsification of Safety Records
FEDERAL LAW WARNING
Falsifying safety records in a mining operation is a serious federal offense. Under Section 110(a) of the Federal Mine Safety and Health Act of 1977 (Mine Act), any operator who violates a mandatory health or safety standard or regulation may be assessed a civil penalty. Under Section 110(f) of the Mine Act, any person who knowingly makes a false statement, representation, or certification in any document filed or required to be maintained pursuant to the Mine Act may be subject to criminal penalties including fines and imprisonment.
VeriField Pro takes the integrity of safety records extremely seriously. All records created, modified, or stored on the Platform are subject to audit logging. We maintain immutable audit trails that record who created, modified, or accessed records, including timestamps and the content of changes. These audit logs may be made available to MSHA inspectors upon lawful request.
If we have reason to believe that safety records on the Platform have been falsified, we reserve the right to (a) immediately suspend the account(s) involved, (b) notify the responsible Client administrator, and (c) cooperate with federal and state authorities as required by law.
5. Account Security
You are responsible for maintaining the security of your account. You must:
- Use a strong, unique password and enable multi-factor authentication when available.
- Never share your login credentials with anyone, including coworkers, supervisors, or IT personnel.
- Log out of the Platform when leaving your device unattended, especially on shared or public devices.
- Immediately report any suspected unauthorized access to support@verifieldpro.com.
- Not use the Platform on jailbroken, rooted, or otherwise compromised devices.
6. Content Standards
All content submitted to the Platform, including inspection notes, hazard descriptions, incident narratives, and uploaded photos, must:
- Be accurate, truthful, and made in good faith.
- Be relevant to mine safety compliance operations.
- Not contain obscene, defamatory, threatening, or discriminatory language.
- Not contain personal information about individuals beyond what is necessary for safety and compliance purposes.
- Not infringe upon the intellectual property or privacy rights of any third party.
7. System Integrity
To maintain the integrity and availability of the Platform for all users, you agree not to:
- Overload the Platform with excessive requests or data uploads beyond normal operational use.
- Use the Platform in a manner that degrades performance for other users.
- Attempt to circumvent rate limits, storage quotas, or other technical safeguards.
- Scrape, harvest, or extract data from the Platform using automated means.
8. Monitoring and Enforcement
VeriField Pro reserves the right, but does not assume the obligation, to monitor use of the Platform for compliance with this AUP. We may investigate any suspected violation and take any action we deem appropriate, including:
- Issuing a warning to the user or Client.
- Temporarily or permanently suspending a user's access.
- Terminating a Client's subscription.
- Reporting the activity to law enforcement or regulatory authorities.
- Pursuing legal action to recover damages or obtain injunctive relief.
9. Reporting Violations
If you become aware of any violation of this AUP, including but not limited to the falsification of safety records, unauthorized access, or misuse of the Platform, please report it immediately:
We will investigate all reports promptly and maintain the confidentiality of the reporter to the extent permitted by law. Retaliation against any person who reports a violation in good faith is strictly prohibited.
10. Consequences of Violations
Violations of this AUP may result in one or more of the following actions, at VeriField Pro's sole discretion:
- Written warning.
- Temporary suspension of access.
- Permanent termination of access.
- Removal of offending content or records.
- Notification to the user's employer (Client administrator).
- Referral to law enforcement or regulatory authorities for criminal investigation.
- Civil action for damages, including costs and attorney's fees.
The severity of the response will be proportional to the nature and impact of the violation, with particular emphasis on violations that endanger worker safety or involve falsification of safety records.
